Intra Company Transfer
The International Mobility Program of Canada describes rules that make it easier for high-skilled foreign individuals to work in Canada as intra-company transferees for a limited time. Candidates who transmit their skills to Canadian enterprises and deliver considerable economic value to Canada are exempt from acquiring a positive LMIA. All countries are subject to the intra-company transferee regulation.

The Immigration and Refugee Protection Regulations govern intra-company transfers, and they are complemented by regulations in international trade agreements for nationals of signatory nations.

General requirements:
  • Candidate is coming to Canada for a temporary period only;
  • Must comply with all immigration requirements for temporary entry.
  • Are currently employed by a multi-national company and seeking entry to work in a parent, a subsidiary, a branch, or an affiliate of that enterprise;
  • Are transferring to an enterprise that has a qualifying relationship with the enterprise in which they are currently employed, and will be undertaking employment at a legitimate and continuing establishment of that company (where 18–24 months can be used as a reasonable minimum guideline);
  • Are being transferred to a position in an executive, senior managerial, or specialized knowledge capacity;
  • Have been continuously employed in a similar full-time position (not accumulated part-time) by the company that plans to transfer them outside Canada for at least one year in the three-year period immediately preceding the date of initial application (via payroll or by contract directly with the company). Extensions may be allowed up to the five- and seven-year maximums indicated to below in the sections Breaks, recaptured time, and duration of work permit limit, and in the part on the categories of work with valid periods that cannot be exceeded. Time spent outside of Canada during the work permit's tenure can be "recaptured," allowing the intra-company transferee to stay in Canada for five or seven years
